These Terms govern your access to and use of MolBAiozyme’s Services. By using our Services, you agree to comply with these Terms and all applicable laws and regulations. MolBAiozyme reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
MolBAiozyme offers a range of bioinformatics services, including but not limited to data analysis, genomic research, proteomic research, chemical computing research and software tools. Our Services are designed for research and educational purposes and are not intended for clinical use or for any other purpose that requires FDA approval.
3.1. Eligibility: You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you meet this eligibility requirement.
3.2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised, you must immediately notify us at drdmr@molbaiozyme.com.
3.3. Accuracy of Information: You agree to provide accurate and complete information when creating an account and using our Services. You are responsible for updating your information to keep it accurate and complete.

5.2. License: MolBAiozyme grants you a limited, non-exclusive, non-transferable license to use our Services for personal or internal business purposes, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions, or you have our written permission.

User Content: By submitting content to MolBAiozyme (e.g., feedback, data, and other materials), you grant MolBAiozyme a worldwide, non-exclusive, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media. You represent and warrant that you have the necessary rights to grant this license.

7.1. No Warranty: Our Services are provided “as is” without any warranties, express or implied. We do not guarantee that our Services will be error-free or uninterrupted. To the maximum extent permitted by law, MolBAiozyme disclaims all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability: To the maximum extent permitted by law, MolBAiozyme will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, whether based on contract, tort, negligence, strict liability, or otherwise, even if MolBAiozyme has been advised of the possibility of such damages. In no event shall MolBAiozyme’s total liability to you for all damages, losses, and causes of action exceed the amount you have paid MolBAiozyme in the last six (6) months, or, if greater, one hundred dollars ($100).
You agree to indemnify, defend, and hold harmless MolBAiozyme, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our Services after such changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, your sole and exclusive remedy is to discontinue using our Services.
These Terms are governed by and construed in accordance with the laws of Gujarat (India), without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the courts located in Gujarat (India) for the purpose of litigating all such claims or disputes.
Any disputes arising out of or related to these Terms, or the Services shall be resolved through good faith negotiations between the parties. If the parties are unable to resolve the dispute through negotiations, either party may seek to resolve the dispute through mediation or arbitration in Gujarat, India, in accordance with the rules of Indian government. The decision of the arbitrator shall be binding and enforceable in any court of competent jurisdiction.
12.1. Termination by You: You may terminate your account at any time by contacting us at drdmr@molbaiozyme.com. Upon termination, you must cease all use of the Services and delete any copies of materials downloaded from the Services.
12.2. Termination by MolBAiozyme: We may terminate or suspend your account and access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
12.3. Effect of Termination: All provisions of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13.1. Entire Agreement: These Terms, together with the Privacy Policy and any other legal notices published by MolBAiozyme, constitute the entire agreement between you and MolBAiozyme concerning the Services and supersede all prior agreements, understandings, or representations, whether written or oral, with respect to the Services.
13.2. Waiver and Severability: No waiver by MolBAiozyme of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of MolBAiozyme to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
13.3. Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without MolBAiozyme’s prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. MolBAiozyme may assign or transfer these Terms at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
13.4. Notices: All notices required or permitted under these Terms shall be in writing and delivered to: MolBAiozyme Pvt Ltd, 3 kamdar colony, Jamnagar, Gujarat, India – 361006, or via email to drdmr@molbaiozyme.com. Notices sent by email will be deemed to have been received on the date sent.
13.5. Force Majeure: MolBAiozyme shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, and internet service disruptions.
13.6. Relationship of Parties: Nothing in these Terms shall be construed to create a partnership, joint venture, agency, or employment relationship between you and MolBAiozyme. Neither party has the authority to bind or act on behalf of the other.
